1. About these terms
These terms govern your use of Fetchabl, available at fetchabl.com ("the site"). Please also read our Privacy Policy, which explains how we handle personal information.
Fetchabl is currently operated independently by James Parsons ("we", "us"), based in England, as an unpaid personal project.
By using the site you accept these terms. If you do not accept them, please do not use the site.
2. What Fetchabl is - and what it is not
Fetchabl is a directory. We publish listings of dogs that UK rescue organisations have told us are available for adoption, so that people looking to adopt can find them.
Fetchabl is not part of the adoption process. We want to be completely clear about this:
- We do not own, house, foster, transport, assess or rehome any dog
- We are not a party to any adoption, agreement or arrangement between you and a rescue organisation
- We do not screen adopters, carry out home checks, or make any decision about whether a dog is placed with anyone
- We do not take payment for any dog, and we do not receive any share of any adoption fee
- We do not verify the accuracy of listings beyond basic checks
When you find a dog on Fetchabl, you can click through to deal directly with the rescue organisation. Their processes, their information, their terms and their decisions apply, not ours.
We strongly recommend having any dog thoroughly examined by a vet as soon as possible after adoption.
3. Where listings come from
Listings on Fetchabl originate from the rescue organisation that has the dog in its care. Depending on the organisation, listings may be:
- Entered and updated by the organisation directly
- Entered and updated by us on the organisation's behalf, using information they have supplied
- Imported automatically from the organisation's own management system
In every case, the underlying information about a dog comes from the rescue organisation. We do not assess, meet or evaluate any dog.
This means:
- A dog shown as available may already have been reserved or adopted
- Details such as age, breed, temperament and suitability are as described by the organisation
- There may be a delay between an organisation updating their own records and that change appearing here
We take reasonable care when entering or importing listings, but we do not guarantee that any listing is accurate, complete or current. Always confirm details directly with the rescue organisation before making any decision.
4. Using the site
You may use Fetchabl for the purpose it is intended: finding dogs available for adoption, or listing dogs if you are a rescue organisation.
Fetchabl is intended for use by adults. If you are under 18, you may browse the site but should involve a parent or guardian before contacting a rescue organisation about adoption.
You must not:
- Use the site for any unlawful purpose
- Copy, scrape, harvest or systematically extract listings or contact details, whether by automated means or otherwise
- Use contact details obtained from the site to send unsolicited marketing
- Attempt to gain unauthorised access to the site, its servers or its database
- Interfere with the site's operation, or place an unreasonable load on it
- Impersonate any person or organisation
- Upload anything unlawful, misleading, or that infringes anyone's rights, including anything pornographic, hateful, discriminatory, violent, or otherwise offensive
- Submit a false or malicious report about a listing
If you believe a listing is inaccurate, inappropriate or breaches these terms, please use the "Report this Listing" link on the dog's page. We review every report.
We may suspend or remove access, and remove any content, if we reasonably believe these terms have been breached.
5. Rescue organisations
This section applies if you are a rescue organisation listed on Fetchabl, whether you manage your own listings or we maintain them for you.
You agree that:
- The person dealing with us is authorised to act on behalf of your organisation
- The information you give us about your organisation and its dogs is accurate, and you will tell us promptly when it changes
- If you're able to let us know when a dog is reserved, adopted, or no longer available, that helps us keep your listing accurate - though where we maintain listings on your behalf, we also check your own website or listings ourselves, so this isn't extra work you need to do
- You will not ask us to list any dog that is not genuinely available for adoption through your organisation
- Every dog listed complies with UK breed-specific legislation, including the Dangerous Dogs Act 1991 and any subsequent restrictions (for example, on XL Bully type dogs). We do not independently verify this.
- The medical information you give us (including microchip and vaccination status) is accurate and meets PAAG guidelines
- You have the right to supply every photograph you give us, and to grant the licence in section 6, and you keep a record of that permission (for example, if a photographer took the photo for you)
- Photographs clearly show the dog, and do not include your own or any third party's logo, watermark or promotional branding
- Where a photograph includes an identifiable person, you have their consent for it to be published on Fetchabl
How we maintain your listings:
- Where we maintain listings for you, we check your own website or listings regularly and update Fetchabl to match, at no extra work for you. Letting us know directly when something changes helps us keep things accurate even faster, but isn't required.
- Either of us may end this arrangement at any time. We will remove your listings on request.
Being listed on Fetchabl is free. We do not charge to list dogs and we do not take any share of an adoption fee.
We may remove a listing or suspend an organisation where we reasonably believe these terms have been breached, where listings appear to be out of date, or where we have been unable to make contact.
If something you've given us - like a photograph or listing details - turns out to infringe someone else's rights, or if you breach these terms, we may ask you to cover any reasonable costs this causes us. This is standard practice, and only applies if something you've provided causes a genuine problem - it isn't about ordinary day-to-day working together.
6. Content and intellectual property
Your content. Rescue organisations retain ownership of the listing text and photographs they upload. By uploading content, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and publicly display that content on Fetchabl and in our promotional material (including social media) for the purpose of promoting the dogs in your care and the Fetchabl service.
This licence ends when you ask us to remove the content or end your partnership with us, except that we may retain copies in backups for a reasonable period, and we are not obliged to remove content already shared on third-party platforms.
Our content. The Fetchabl name, logo, site design and underlying software are owned by us. You may not copy or reuse them without permission.
If something on Fetchabl is yours. If you believe content on Fetchabl infringes your copyright or other rights, please contact us and we will remove it or credit you, whichever you prefer.
7. Cost
Fetchabl is free to use, for both adopters and rescue organisations. We do not charge rescue organisations to be listed, and we do not take commission on adoptions.
8. Availability
We aim to keep Fetchabl available, but we do not guarantee it. The site may be unavailable for maintenance, or because of problems beyond our control. We may change, suspend or discontinue any part of the service.
9. Our liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.
Subject to that:
- We provide the site "as is". To the extent permitted by law, we exclude all warranties, whether express or implied.
- We are not liable for any loss arising from an adoption, an attempted adoption, or any dealing between you and a rescue organisation.
- We are not liable for the behaviour, health, temperament or suitability of any dog listed on the site.
- We are not liable for the acts or omissions of any rescue organisation, or for the content of any external website we link to.
- We are not liable for indirect or consequential loss, or for loss of profit, data or opportunity.
- Where we are liable, our total liability to you is limited to £100.
If you use the site as a consumer, nothing here affects your statutory rights.
10. Links to other sites
Fetchabl links to rescue organisations' own websites and may link to other third-party sites. We do not control those sites and are not responsible for their content, their practices, or anything that happens once you leave Fetchabl.
11. Changes to these terms
We may update these terms. The date at the top shows when they last changed. Continuing to use the site after a change means you accept the updated terms. If we make a significant change affecting rescue organisations, we will notify our partner organisations directly.
12. Resolving issues
If something goes wrong, please contact us first so we can try to put it right. Most issues can be resolved this way without needing to take things further.
13. General
If any part of these terms is found to be unenforceable, the rest of these terms remain in full effect.
We may transfer or assign these terms, and our rights and obligations under them, to another organisation - for example, if Fetchabl is taken over by or transferred to a company. We will tell affected rescue organisations if this happens.
If we do not act on a breach of these terms, that does not mean we give up our right to act on it, or any future breach.
14. Law and jurisdiction
These terms are governed by the law of England and Wales. Any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales.
